TERMS & CONDITIONS

  1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

    Eligibility

  2. Entry is only open to foodservice businesses operating in Australia (each an “Eligible Business”). A ‘foodservice business’ is a business that serves food outside of a customer’s home including, but not limited to, full-service restaurants and cafes, pubs or clubs, independent pizza restaurants, independent quick service restaurants, Health and Aged Care operators. Global or nationally operated chain quick service restaurant outlets are not Eligible Businesses.
  3. Eligible Businesses must be within the Promoter’s trading terms throughout the Promotional Period (defined below) and must not have overdue monies owing as at 23/12/2024 in order to be eligible to claim any prize.
  4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

    Promotional Period

  5. Prior to the commencement of the Promotional Period (defined below), authorised representatives, on behalf of an Eligible Businesses can pre-register their interest to participate in this promotion. Registrations open on 07/08/2024 and close at 11:59pm AEST on 27/08/2024 (“Pre-Registration Period”). For clarity an authorised representative for an Eligible Business must be 18 years or over and must be an employee of the Eligible Business authorised to register for the purposes of this promotion as well as process orders on behalf of the Eligible Business (“Authorised Representative”).
  6. Eligible Businesses that register their interest during the Pre-Registration Period, will each be awarded ten (10) entries into each of the four (4) x monthly draws (40 entries in total), as detailed below (“Bonus Entries”).
  7. Subject to Clauses 5 and 6 above, entries into the promotion open on 28/08/2024 and close at 11:59pm AEDST on 23/12/2024 (“Promotional Period”). The Promotional Period is divided into four (4) monthly entry periods (“Monthly Entry Period”). Entries open and close for each Monthly Entry Period on the dates and times listed in the table below.

    How To Enter

  8. To be eligible to enter, an Authorised Representative, on behalf of an Eligible Business, must undertake the following steps, during the Promotional Period:
    • Purchase a carton of product from any of the following product range and categories, being Edgell Chips, Edgell Vegetables and/or the I&J Value Added Seafood range (each a “Category”) or a carton of any new product released during the Promotional Period (“New Product”);
    • Visit www.more4more.simplotfoodservice.com.au and follow the prompts to the competition entry page;
    • Input the requested details (if not already registered);
    • Include the details of the products purchased by Category group or New Product;
    • Check the box agreeing to these Terms and Conditions and the Promoter’s Privacy Policy; and then
    • Submit the fully completed online entry form.
  9. Once the form has been submitted in accordance with Clause 8, the Authorised Representative will be asked to scratch an online game card to reveal if the Eligible Business is a winner of an instant prize. For clarity, the online game card will not be available during the Pre-Registration Period and will only be provided when an entry is submitted in accordance with Clause 8 above during the Promotional Period. All valid entries received from Eligible Businesses, regardless of whether or not they win an instant prize, will automatically be awarded the relevant number of entries into the relevant Monthly Draw (defined below) depending on the products purchased in a single transaction, as follows:
    • Purchase from 1 Category and earn ten (10) entries.
    • Purchase from 2 Categories in a single transaction and earn forty (40) entries.
    • Purchase from all 3 Categories in a single transaction and earn ninety (90) entries;
    • Purchase a New Product and earn one hundred (100) entries.
    For clarity, the Promoter may release various New Products during the Promotional Period and will advise Eligible Businesses of New Products that are available to be purchased. Only one (1) New Product will be available at any one time during the Promotional Period.
  10. Multiple entries permitted, subject to the following conditions:
    1. A maximum of ten (10) Bonus Entries are permitted per Eligible Business per Monthly Draw subject to that Eligible Business complying with clause 6;
    2. Only one (1) entry form may be submitted per Eligible Business per day;
    3. Up to a maximum of one hundred and ninety (190) entries will be awarded per transaction depending on the number of Categories purchased from and/or New Products purchased;
    4. Each entry must be submitted separately; and
    5. All entries must comply with the entry requirements.
  11. Eligible Businesses must retain their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Eligible Businesses entries and forfeiture of any right to a prize.
  12. All prizes will be awarded to the owner/manager of the winning Eligible Business who may, in their absolute discretion, allocate the prize to any employee of that Eligible Business.

    Monthly Draws

    There will be one (1) draw conducted for entries received in each Monthly Entry Period with a total of four (4) draws (each a “Monthly Draw”). Entries open and close for each Monthly Entry Period on the dates and times specified in the table below. All Monthly draws will take place at 1:00pm at 41 Stubbs Street, Kensington, VIC 3031 on the dates and times specified in the table below. All times indicated are AEST/AEDST unless specified otherwise. Non-winning entries in each Monthly Draw will be entered into any subsequent Monthly Draws. Winning Eligible Businesses will be notified in writing within seven (7) business days of the relevant Monthly Draw and be asked to provide proof of purchase as part of the validation process. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The names and postcodes of winning Eligible Businesses will published online at www.more4more.simplotfoodservice.com.au on the dates indicated in the table below.

  13. The first valid entry drawn, in each Monthly Draw, will each win a $10,000 worth of Simplot branded Pre-Paid Visa Cards.
  14. Only one (1) Monthly Draw prize is permitted per Eligible Business (excluding SA).
  15. As a condition of accepting a Monthly Draw prize, the owner/manager of the winning Eligible Business must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

    Instant Prizes

  16. Instant win prizes (“Instant Prize”) available to be during the Promotional Period are as follows:
    • 1400x $50 Simplot branded Pre-Paid Visa Cards;
    • 400x $100 Simplot branded Pre-Paid Visa Cards; and
    • 200x $250 Simplot branded Pre-Paid Visa Cards.
  17. There will be one hundred and eighteen (118) Instant Prizes to be won each week of the Promotional Period, commencing each Wednesday and ending the following Tuesday, except in the case of the last two (2) weeks where there will be one hundred and fifteen (115) Instant Prizes to be won. In the event there are any unwon Instant Prizes at the end of a particular week, those unwon Instant Prizes will roll over into any subsequent weeks.
  18. Only one (1) Instant Prize permitted per Eligible Business per week (excluding SA).

    General

  19. Where a winning Eligible Business is unable to accept a prize, due to their own internal policies, the Eligible Business will forfeit their right to the prize and the prize will be awarded to a reserve Eligible Business drawn.
  20. The Promoter, reserves the right, at any time, to verify the validity of entries and Eligible Business (including an Eligible Business’s place of operation and order history) and reserves the right, in its sole discretion, to disqualify any Eligible Business who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  21. The Promoter’s decision is final and no correspondence will be entered into.
  22. Incomplete, or illegible entries will be deemed invalid.
  23. If there is a dispute as to the identity of an Eligible Business, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Business.
  24. Any ancillary costs associated with redeeming the Pre-Paid Visa Cards are not included. Any unused balance of the Pre-Paid Visa Cards will not be awarded as cash. Redemption of the Pre-Paid Visa Cards is subject to any terms and conditions of the issuer including those specified on the Pre-Paid Visa Cards.
  25. Subject to the unclaimed prize draw clause, if for any reason a winning Eligible Business does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited.
  26. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  27. Total prize pool value is up to $200,000.
  28. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  29. A draw for any unclaimed Monthly Draw prizes or any Instant Prizes that are won, but remain unclaimed, may take place on 06/02/2025 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within seven (7) days of the draw. The names and Postcodes of winning Eligible Businesses will be published online at www.more4more.simplotfoodservice.com.au on 13/02/2025.
  30. Authorised Representatives, on behalf of an Eligible Business, consent to the Promoter using the Eligible Business’ name, likeness and/or image in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  31. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Business; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  32. Any cost associated with accessing the promotional website is the Eligible Businesses responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Business to automatically enter repeatedly is prohibited and will render all entries submitted by that Eligible Business invalid.
  33. Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Instant win game materials void if stolen, forged, mutilated or tampered with in any way.
  34. Liability for any tax (other than FBT) arising out of participation in this promotion (including acceptance of a prize) is the sole responsibility of the Eligible Business. Eligible Businesses should seek independent financial advice in this regard.
  35. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  36. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an Eligible Business; or (f) use of a prize.
  37. The Promoter collects the personal information ("PI") from the Authorised Representative and the Eligible Business in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.simplot.com/privacy-policy.  In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Authorised Representative and the Eligible Business. The Privacy Policy also contains information about how Authorised Representative and the Eligible Business may opt out, access, update or correct their PI, how Authorised Representative and the Eligible Business may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter may disclose PI outside of Australia, see the Promoter’s Privacy Policy for more details.
  38. The Promoter is Simplot Australia Pty Ltd (ABN 98 070 579 609) of Chifley Business Park, 2 Chifley Drive Mentone Victoria 3194.
